LEASING MANDATES FOR MASTER TYRE PROPERTIES AND THRESON

LEASING MANDATE

Master Tyre Properties (Pty) Ltd are the Landlords of the properties listed on this website.

This is not a sole or exclusive mandate.

We hereby grant a leasing mandate to you to procure a tenant for us in respect of any of these properties on the terms and conditions set out below:

  1. In order for us to accept your introduction of a ready, willing and able tenant, the following two conditions must be fullfilled, and until such time we reserve the right to accept other introductions from any other brokers for any prospective tenant.

a. You must have shown the prospective tenant around the building or property, and

b. The prospective tenant must have shown further interest in the building or property by either submitting a written “Offer to Rent” for
     the mandated rental OR by arranging a meeting between the prospective tenant, Master Tyre Properties (Pty) Ltd and yourselves.

  1. The acceptance of your introduction by Master Tyre Properties (Pty) Ltd shall be valid for one month only from the date of our acceptance and shall only be for that specific building or property.
  1. Should you be the effective cause of a signed written agreement of lease then agents commission will only be payable to you on the initial lease term and not on any lease extension, renewal(s) or option periods or additional space rented at a later date or purchase of the building or property by the tenant. Commission, as calculated below, will be paid 50% on signature of the lease and the balance on commencement of payment of rental in terms of the lease.
  1. Commission is calculated as follows:
    • first 2 years rental – greater of 1 months rental or 5% of the monthly rental
    • next 3 years rental – 2.5% of the monthly rental
    • next 3 years rental – 1.5% of the monthly rental
    • remaining balance of the lease – 1% of the monthly rental
  1. This mandate is effective immediately and replaces all previous mandates.
  1. By introducing a tenant or providing us with the written “Offer to Rent” on one of our vacant properties, you will be deemed to have accepted all the terms and conditions of this mandate unless a written variation of these terms and conditions has been agreed as set out in 8.
  1. Please note that NO AGENTS BOARDS are allowed on any of our buildings and/or properties without our prior written consent.
  1. No addition, variation, cancellation or alteration of this mandate will be binding unless reduced to writing and signed by us.
  1. This is the entire agreement and no extension of time or indulgence will be interpreted as a waiver of any of our rights in terms of this mandate.
  1. No warranties, representations, guarantees, terms and/or conditions of whatsoever nature, save as contained herein, have been made or given in regard to any matter affecting this mandate.
  1. Any fees, costs or charges associated with finding a ready, willing and able tenantor for advertising the building or property or for screening any prospective tenant(s) shall be at the agent’s own cost.
  2. Whilst every care is taken in the compilation of the information set out in the schedule, Master Tyre Properties (Pty) Ltd and/or its subsidiaries, affiliates, employees and agents cannot be held responsible for the accuracy of the information provided and shall not be liable for any loss, damages or claim whatsoever suffered by any third party, resulting from the use in any way of such information.
